Terms of Service. The agreement for using SuperEbook.

1. Acceptance of these Terms

These Terms of Service ("Terms") are a legal agreement between you and SuperEbook ("SuperEbook," "we," "us," or "our") and govern your access to and use of the SuperEbook website, app, and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

2. The Service

SuperEbook is an AI book studio. You describe the book you want and, optionally, add your own source material — notes, PDFs, Word documents, or transcripts. SuperEbook plans the book with you (title options, a brief, and an outline you can edit, at no charge), writes the chapters, designs cover options, and exports publish-ready files such as PDF, EPUB, and DOCX. Chapters are generated with the help of third-party AI models and, where you provide material, grounded in the content you upload.

Because output is generated by AI, it can contain errors, inaccuracies, outdated information, or phrasing that resembles other works, and results are not guaranteed to be unique. You are responsible for reviewing, fact-checking, and editing everything before you publish or otherwise rely on it.

3. Eligibility and your account

You must be at least 16 years old (or the age of majority in your jurisdiction, if higher) to use the Service. You are responsible for the information you provide, for keeping your login secure, and for all activity that happens under your account.

You sign in with Google or, where it is offered, with a one-time code sent to your email; we do not store account passwords. Tell us promptly if you believe your account has been accessed without your permission.

4. Credits

Credits are the unit of use in SuperEbook. Planning a book — title options, the brief, and the outline — does not use credits. Writing a book, and certain other actions such as regenerating a chapter, generating more cover options, rewriting a passage with AI, or adding web research, consume credits at the rates shown on our Pricing page and in the app before you confirm. We may adjust credit costs as the Service changes, but we will not retroactively increase the cost of an action you have already started.

New accounts receive a free grant of credits on signup so you can try the Service without a card. An email address that previously belonged to a deleted account does not receive the free grant again.

Credits do not expire. The credits included with a monthly plan are added to your balance at the start of each billing cycle; they are not reset, wiped, or reduced at the end of a cycle, so anything you don't spend simply carries over. Credits you buy outright — a one-time credit pack — behave the same way. If we ever intend to change this, we will tell you in advance and it will only apply to credits granted after the change.

Credits have no cash value, are not a stored-value or gift-card instrument, and cannot be transferred, resold, or redeemed for cash except where required by law or under our refund policy. Credits are consumed when the action they pay for runs. If writing a book fails before every chapter is written, the credits reserved for it are returned to your balance automatically; the same applies when another paid action — a chapter regeneration, more cover options, or an AI rewrite — fails, and when web research finds nothing usable.

5. Payments, billing, and merchant of record

Paid plans and purchases are sold and processed by Dodo Payments, which acts as the merchant of record (the seller of record) for the transaction. That means Dodo — not us — is your counterparty for the payment itself: Dodo takes the payment, issues the receipt or invoice, and assesses, collects, and remits any applicable sales tax, VAT, or GST. Prices are shown in US dollars; tax may be added at checkout depending on where you are. Your purchase is therefore also subject to Dodo's terms and privacy policy, alongside these Terms, which continue to govern your use of the Service itself.

We do not receive or store your full card number. Subscriptions renew automatically at the then-current price until you cancel. You can cancel at any time in the billing portal (Billing in the app opens it); cancellation stops future renewals, and your plan remains active through the end of the period you have already paid for. Credits already in your balance are not removed when you cancel. Deleting your account is different: it cancels a subscription immediately (see §15). Prices may change, but we will give you notice before a change affects a renewal.

Because Dodo is the merchant of record, refunds and chargebacks are executed through Dodo. When a payment is refunded or charged back, we reverse the credits and access it paid for (see §6).

6. Fair refunds

We run a fair refund policy, not a "no refunds, ever" policy. Credits come back automatically when writing fails (§4). If a finished book genuinely misses the mark, or you were charged for something you didn't mean to buy, contact us and a person will look at it case by case.

Our Refunds & cancellation policy sets out how refunds and cancellations work, including what happens to credits and downloads when a payment is refunded. Nothing here limits any non-waivable refund or cancellation rights you may have under the consumer law that applies to you.

7. Your material and the rights you grant us

You keep ownership of the notes, files, transcripts, and other content you upload or paste into SuperEbook ("Your Material"). You grant us a limited, non-exclusive license to host, store, copy, split, index, and process Your Material solely to operate the Service and produce your book for you — for example, retrieving the most relevant passages while writing each chapter.

We do not use Your Material, or the books you generate, to train AI models — ours or anyone else's. How Your Material is stored, retrieved, and kept private is described in our Privacy Policy.

You represent and warrant that you own Your Material or have the necessary rights to it, and that our processing of it as described will not infringe anyone's copyright, trademark, privacy, confidentiality, or other rights. Do not upload material you do not have the rights to use.

8. Ownership of the books you create

As between you and SuperEbook, you own the book you generate. You get full commercial rights: sell it, give it away, gate it behind an email list, or fold it into your funnel. There is no SuperEbook watermark and no required attribution back to us.

Two honest caveats. First, AI-generated output may not be eligible for copyright in every country, and comparable prompts can produce similar output for other users — so we can't promise your book is unique or fully protectable. Second, you are responsible for the book you publish, including its accuracy, its legality, and that it does not infringe anyone else's rights. We recommend you review and edit before publishing.

9. AI disclosure and platform rules (including Amazon KDP)

Books made with SuperEbook are AI-generated. Many publishing and retail platforms require creators to disclose AI-generated or AI-assisted content. In particular, Amazon Kindle Direct Publishing (KDP) requires you to disclose AI-generated content when you publish a book — you must answer its AI-content questions truthfully at upload.

You are solely responsible for making any required "AI-generated" disclosures and for complying with the content, quality, and metadata policies of every platform you publish on. We provide guidance to help you disclose correctly, but we never claim that AI-generated content is "undetectable," and we do not endorse hiding the use of AI where a platform asks you to declare it.

10. Acceptable use

You agree not to use the Service to create, upload, or distribute:

  • content that is illegal, or that promotes or facilitates illegal activity;
  • content that infringes copyright, trademark, or other rights, or material you do not have the rights to use;
  • hateful, harassing, or violence-inciting content, or content that demeans people based on protected characteristics;
  • sexual content involving minors, or non-consensual, exploitative, or otherwise abusive sexual content;
  • deceptive, fraudulent, or misleading content, spam, or malware;
  • content that violates another person's privacy or confidentiality.

You also agree not to reverse engineer, scrape, resell, or overload the Service, to circumvent credit limits, rate limits, or security measures, or to use the Service to build a competing product. We may suspend or limit accounts that break these rules.

11. Third-party services

The Service relies on third parties — including hosting (Vercel), our database and backend (Convex), file storage and PDF rendering (Cloudflare), AI model providers reached through Vercel's AI Gateway, cover-art generation (fal.ai), email delivery, and payment processing (Dodo Payments). Their services are governed by their own terms, and we are not responsible for third-party services or content. What each of them receives is listed in our Privacy Policy.

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI output will be accurate, complete, original, or fit for your purpose. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of liability

To the maximum extent permitted by law, SuperEbook and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim, and (b) USD 100. Nothing in these Terms limits liability that cannot be limited under applicable law — including liability for fraud, for death or personal injury caused by negligence, and any non-waivable rights you have as a consumer.

14. Indemnification

You agree to indemnify and hold SuperEbook harmless from any claims, damages, liabilities, and reasonable legal costs arising out of Your Material, the books you generate or publish, your use of the Service, or your breach of these Terms or of any third-party or platform policy.

15. Deleting your account, and termination

You can stop using the Service at any time, and delete your account yourself in Settings. Deleting your account is permanent: it deletes your books (including any still being written), the material you uploaded, your profile, and your sign-in; it cancels any active subscription immediately, without a refund for the rest of the billing period; and any unused credits are forfeited. We keep records of your payments and credit transactions, under an anonymized account, for as long as accounting, tax, and dispute rules require — our Privacy Policy lists exactly what is kept. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; provisions that by their nature should survive — including ownership, disclaimers, limitation of liability, indemnification, and governing law — will survive.

16. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, give you additional notice (for example, by email or an in-app message). Your continued use of the Service after changes take effect means you accept the updated Terms.

17. Governing law and disputes

Before starting formal proceedings, please email us and give us 30 days to sort the problem out. Most things are faster to fix that way, and we would rather fix them.

These Terms are governed by the laws of the place where the operator named in §18 is established, without regard to conflict-of-laws rules, and its courts have jurisdiction over any dispute arising out of them.

This does not override consumer protection you cannot contract out of: if you use the Service as a consumer, you keep the mandatory rights and the right to bring proceedings in the courts of the country you live in, where the law gives you that.
